Valsts policijas Speciālo uzdevumu vienību darbības tiesiskais regulējums

Abstract

ANOTĀCIJA Maģistra darba temats ir “Valsts policijas Speciālo uzdevumu vienības darbības tiesiskais regulējums.” Latvija ir viena no Eiropas Savienības dalībvalstīm ar savu ģeogrāfisko atrašanās vietu, kas ir Savienības ārējā robeža. Šī brīža ģeopolitiskā situācija liek nepārtraukti sekot politiskajām norisēm, kas tiek risinātas mūsu valsts robežas tuvumā un var ietekmēt valsts iekšējo drošību. Demokrātijas un valsts iekšējās drošības nodrošināšanā, valsts kā publiskās administrācijas subjekts šo tiesību nodrošināšanu ir deleģējusi Valsts policijai, kuras struktūrā ir Speciālo uzdevumu vienības, kas savus uzdevumus veic tām deleģēto funkciju ietvaros. Lai varēt pastāvēt demokrātiska valsts tai jāspēj nodrošināt sabiedrības un indivīda pamattiesību un brīvību ievērošana, ko valsts ir atzinusi par vērtību un aizsargā ar likumu, kā arī likumā paredzot, kad cilvēka pamattiesības un brīvības var tikt ierobežotas, kas nepieciešamas demokrātiskā sabiedrībā, lai aizstāvētu valsts drošību, aizsargātu citu tiesības un brīvības no prettiesiskiem apdraudējumiem, līdz ar to valsts speciālajos likumos ir noteikusi pienākumus un tiesības Valsts policijas Speciālo uzdevumu vienībām pielietot līdzekļus prettiesisku apdraudējumu novēršanai. Pēc darba izstrādes, darba autors secina, ka speciālajos likumos jāiekļauj normās, kas veicinātu Speciālo uzdevumu vienības darbinieku, kas savus tiešos pienākumus pilda paaugstināta stresa un cilvēka veselībai un dzīvībai bīstamos apstākļos, kam nepieciešama gan mentāla, gan fiziska īpaša sagatavotība, gan specifisku zināšanu kopums tiesisko paļāvību, nodrošinot darbinieka tiesisko aizsardzību, kā arī veicinātu Valsts policijas Speciālo uzdevumu vienībām izvirzīto uzdevumu izpildi. Tas nozīmē, ka Valsts policijas Speciālo uzdevumu vienību darbinieki būtu maksimāli tiesiski aizsargāti sagatavoti savu uzdevumu veikšanai baudot valsts un sabiedrības uzticēšanos. ANNOTATION The subject of the Master's thesis is “The legal regulation of the State Police Special Task Force”. Latvia is one of the Member States of the European Union with its geographical location as an external border of the Union. The current geopolitical situation requires us to constantly monitor the political developments that are taking place in the vicinity of our country's border and may affect the internal security of the country. In order to ensure democracy and the internal security of the country, the State, as the subject of public administration, has delegated this right to the State Police, which has Special Task Forces within its structure, which carry out their tasks within the framework of the functions delegated to them. In order for a democratic state to exist, it must be able to ensure respect for the fundamental rights and freedoms of society and the individual, which the state has recognised as a value and protects by law, as well as providing by law for when fundamental human rights and freedoms may be restricted as necessary in a democratic society to defend national security and protect the rights and freedoms of others from unlawful threats, and therefore the state has established in special laws the obligations and rights of the Special Task Forces of the State Police to use means to prevent unlawful threats. After elaboration of the thesis, the author of the thesis concludes that the special laws should include norms that would promote the legal reliance of the Special Task Force employees who perform their direct duties in conditions of increased stress and danger to human health and life, which require both mental and physical special training, as well as specific knowledge, ensuring the legal protection of the employee, as well as promoting the performance of tasks assigned to the Special Task Force of the State Police. This means that the members of the Special Task Forces of the State Police would be prepared to perform their tasks with maximum legal protection, enjoying the trust of the state and the public.
