Elektroskūteru vadītāju atbildība un tiesiskais regulējums ceļu satiksmē

Abstract

Par sava maģistra darba tēmu autore izvēlējās „ Elektroskūteru vadītāju tiesiskais regulējums un atbildība ceļu satiksmē ”, kam ir cieša saskarsme gan ar administratīvo vai krimināl pārkāpumu un atbildību, tieši tāpēc, ka dzīvē pastāvīgi notiek indivīda savstarpējā mijiedarbība ar valsts institūcijām. Darbā aplūkots elektroskrejriteņa vadītāja tiesiskie aspekti un atbildība no ceļu satiksmes dalībnieka skatu punkta izejot no Latvijā un citās valstīs spēkā esošā normatīvo aktu regulējuma. Šobrīd Latvijā Likumdevējs ir noteicis atšķirīgu administratīvo atbildību par vispārīgo ceļu satiksmes noteikumu neievērošanu gājējam, velosipēda un mehāniska transportlīdzekļa vadītājam, proti - administratīvā atbildība tiek diferencēta atkarībā no tā, kas (gājējs, velosipēda vadītājs, mehāniskā transportlīdzekļa vadītājs) ir pārkāpis vispārīgo ceļu satiksmes noteikumus. Turklāt Ceļu satiksmes likums paredz velosipēdistu pārkāpumiem tikai par noteikta veida administratīvajiem pārkāpumiem, proti –konkrētas soda sankcijas, kas ietvertas CSL. Līdz ar ko izpētot spēkā esošo regulējumu autore vēlas paplašināt administratīvās atbildības “rāmjus” sniedzot konkrētus priekšlikumus par elektroskrejriteņu vadītāju sodīšanu, ja tiek pārkāpti ceļu satiksmes noteikumi. Darbs izstrādāts administratīvo tiesību jomā. Darbs sastāv no Ievada, 3 nodaļām ar apakšnodaļām un nobeiguma, kurā ietverti autores secinājumi un priekšlikumi– kopā 84 lapaspuses. Pētījuma izstrādes normatīvo bāzi sastāda Latvijas un starptautiskie normatīvie akti - kopā 31 avots, plašs literatūras un zinātnisko rakstu klāsts, publikācijas un pētījumi, kā arī internetā pieejamie resursi - kopā 65 avoti un judikatūras materiāli.

The author chose “Legal Regulation and Responsibility of Electric Scooter Drivers in Road Traffic” as the topic of his master's thesis, which has close contact with both administrative or criminal violation and liability, precisely because in life the individual constantly interacts with state institutions. The paper deals with the legal aspects and responsibilities of the driver of an electric scooter from the point of view of a road traffic participant starting from the regulation of regulatory enactments in force in Latvia and other countries. Currently in Latvia, the Legislator has established different administrative liability for non-compliance with general road traffic regulations for pedestrians, bicycle and motor vehicle drivers, ie - administrative liability is differentiated depending on who (pedestrian, bicycle driver, motor vehicle driver) has violated general road traffic regulations. In addition, the Road Traffic Law provides for infringements by cyclists only for certain types of administrative offenses, namely - specific penalties included in the CSL. Therefore, by researching the existing regulation, the author wants to expand the “frames” of administrative liability by providing specific proposals on the punishment of electric scooter drivers in case of violation of road traffic regulations. The work is developed in the field of administrative law. The work consists of an introduction, 3 chapters with subsections and a conclusion, which contains the author's conclusions and proposals - a total of 84 pages. The normative base for the development of the research consists of Latvian and international normative acts - a total of 31 sources, a wide range of literature and scientific articles, publications and research, as well as resources available on the Internet - a total of 65 sources and case law materials.
