Nacionālā un etniskā naida izraisīšanas krimināltiesiskais raksturojums

Abstract

Nacionālā, etniskā un rasu naida izraisīšana sabiedrībā, kas īpaši aktualizējusies kopš Covid-19 pandēmijas sākuma un pēc Krievijas agresijas Ukrainā, starptautiskajos un Eiropas Savienības cilvēktiesību dokumentos ir atzīta par cilvēktiesību pārkāpumu, draudiem likuma varai un demokrātijas stabilitātei. Rasisms un ksenofobija tieši pārkāpj brīvības, demokrātijas, cilvēktiesību un pamatbrīvību ievērošanas principus, kuri ir Eiropas Savienības pamatā un ir kopēji dalībvalstīm. Darba pētījuma mērķis ir, pamatojoties uz Latvijas un starptautisko normatīvo aktu, atziņu un tiesu prakse analīzi nacionālā un etniskā naida izraisīšanas ietvaros, identificēt nozīmīgākās problēmas un to ietekmi uz cilvēktiesību aizsardzības veicināšanu un izstrādāt priekšlikumus to novēršanai. Mērķa sasniegšanai pētījuma ietvaros autors definē šādus uzdevumus: veikt nacionālā un etniskā naida izraisīšanas jēdziena un būtības raksturojumu; izanalizēt nacionālā un etniskā naida izraisīšanas normatīvo regulējumu (starptautiskais un nacionālais normatīvais regulējums, pazīmes, kas var liecināt par noziedzīgu nodarījumu utt.); izpētīt nacionālā un etniskā naida izraisīšanas kā noziedzīga nodarījuma sastāvu; analizēt būtiskākās problēmas Krimināllikuma 78.panta piemērošanas praksē; salīdzināt Krimināllikuma 78.panta regulējumu un regulējumu citās valstīs. Provoking national, ethnic and racial hatred in a society that has been particularly acute since the start of the COVID-19 pandemic and after Russian aggression in Ukraine, international and European Union human rights records have declared a violation of human rights, threats to the rule of law and the stability of democracy. Racism and xenophobia directly violate the principles of freedom, democracy, respect for human rights and fundamental freedoms, which underpin the European Union and are common to the Member States. The purpose of the work study is to identify the most significant problems and their impact on the promotion of human rights protection and to develop proposals for the elimination thereof, based on analysis of Latvian and international laws and regulations, findings and case law within the framework of the incitement of national and ethnic hatred. In order to achieve the objective within the scope of the study, the author defines the following tasks: a description of the concept and nature of incitement to national and ethnic hatred; analyse the regulatory framework for the incitement of national and ethnic hatred (international and national regulations, indications of a criminal offence, etc.); explore the composition of national and ethnic hatred as a criminal offence; analyse the main problems in the practice of applying Section 78 of the Criminal Law; compare the provisions of Section 78 of the Criminal Law and those of other States.
