dc.description.abstract | Bakalaura temats ir “Sejas atpazīšanas reāllaika biometriskās tālidentifikācijas Izmantošanas tiesiskie aspekti tiesībsaizsardzības jomā”. Bakalaura darba mērķis ir analizēt un izpētīt reāllaika sejas atpazīšanas tehnoloģiju izmantošanas tiesisko regulējumu tiesībaizsardzības jomā ES un nacionālajos tiesību aktos, identificējot reāllaika sejas atpazīšanas tehnoloģiju izmantošanas problēmas tiesībaizsardzības jomā ES un Latvijā, un sniegt iespējamos risinājumus tiesiskā regulējuma pilnveidē. Temata aktualitāte saistās ar apstākli, ka daudzas pasaules valstis arvien vairāk integrē mākslīgā intelekta sistēmas tiesībaizsardzībā, izmantojot arī sejas atpazīšanas reāllaika biometriskās tālidentifikācijas (reāllaika) tehnoloģijas (piemēram, lidostās un citās publiskās vietās). No vienas puses, izmantojot sejas atpazīšanas reāllaika biometrisko tālidentifikāciju, tiesībaizsardzības iestādes ir guvušas lielu labumu, kas palīdz atklāt noziegumus un veikt ātrāku noziegumu izmeklēšanu. Taču no otras puses, sejas atpazīšanas tehnoloģiju izmantošana tiesībaizsardzības jomā, ir apdraudēta raugoties tieši no cilvēktiesību aspekta, īpaši privātuma un datu aizsardzības viedokļa. Papildus reāllaika sejas biometriskās tālidentifikācijas tehnoloģijas ir pakļautas aizspriedumiem, un neprecizitātēm un var iejaukties privātumā, ja to izmanto slepeni, tā ir saistīta ar pārkāpumiem digitālo masu novērošanā, diskriminācijas pieļaušanā, iejaukšanos privātajā dzīvē. Līdz ar to ir nepieciešams atrast pareizo tiesību līdzsvaru, jo nepareizi īstenota vai īstenota, pienācīgi neņemot vērā tās sekas, sejas atpazīšana var izraisīt nopietnus cilvēktiesību pārkāpumus un kaitēt personām, jo īpaši tām, kuras dzīvo mazapkalpotās kopienās. Speciālos tiesību aktos, kuri regulē robežas starp personu tiesībām datu aizsardzību un kompetento iestāžu tiesībām apstrādāt personu biometriskos datus ir izplūdušas, tajos nav regulēts cik tālu un konkrēti, kādos gadījumos kompetentās iestādes ir tiesīgas iejaukties personu privātajā dzīvē, izmantojot sejas atpazīšanas tehnoloģijas ar mākslīgā intelekta palīdzību. Darbā noslēgumā tiek sniegti priekšlikumi minēto trūkumu novēršanai. | lv-LV |
dc.description.abstract | The subject of the Bachelor Thesis is “Legal aspects of the use of real-time biometric face recognition systems in the field of law enforcement”. The aim of the Bachelor's thesis is to analyse and study the legal framework of the use of real-time facial recognition technologies in law enforcement in the EU and national legislation, identifying problems, and to provide possible solutions to improve the legal framework. The actuality of the subject is linked to the fact that many countries in the world are increasingly integrating artificial intelligence systems into law enforcement, also using real-time biometric facial recognition technologies (e.g. at airports and other public places). On the one hand, through real-time biometric facial recognition systems, law enforcement authorities have benefited greatly, helping detect crimes and conduct faster crime investigations. On the other hand, however, the use of facial recognition technologies in law enforcement is at risk from a human rights point of view, in particular from the point of view of privacy and data protection. In addition, real-time facial biometric technologies are subject to bias and inaccuracies and may interfere with privacy because they are used in secret way, involving violations of digital mass monitoring, discrimination. Consequently, it is necessary to find the right balance of rights, as facial recognition can lead to serious violations of human rights and harm people, especially those living in marginalised communities, either wrongly implemented or implemented without due regard for its consequences. Specific legislation regulating the boundaries between the rights of individuals to protect data and the right of competent authorities to process personal biometric data has blurred, does not regulate how far and in what specific cases competent authorities are entitled to interfere with the privacy of individuals using facial recognition technologies through artificial intelligence. At the end of the Bachelor thesis author has made proposals how to improve existing legal framework. | en-UK |
