Abstract
Tēmas aktualitātes pamatojas ar atziņu, ka tiesiski noslēgts līgums ir jāpilda un vēlāk radušās grūtības no saistībām neatbrīvo.
Bakalaura darbs „Nepārvaramās varas iestāšanās ietekme uz līguma saistību izpildi” ir izstrādāts, lai novērtētu kā saprast jēdzienu nepārvaramā vara un kādas problēmas rodas praksē.
Bakalaura darba mērķis – izpētīt saistību izpildes nosacījumus nepārvaramās varas iestāšanās gadījumā, apzinot ar to saistītos problēmjautājumus.
Pētījuma rezultātā gūtā galvenā atziņa ir, ka nepildīt saistības pat, ja iestājas nepārvaramā vara nav tiesiski. Līguma pusēm vai nu jāvienojas par nepārvaramās varas noteikumiem, vai strīdu izskata tiesa, saskaņā ar tiesisko regulējumu.
Bakalaura darbs sastāv no trīs nodaļā. Darbā tiek izmantoti tiesību akti, tiesību zinātnieku atziņas, publikācijas pētāmajā jautājumā, kā arī tiesas spriedumi.
The topics are highlighted by the knowledge that the a legally concluded contract must be performed and that subsequent difficulties are not relieved of obligations. The work of the Bachelor “Impact of compelling power on performance of contract obligations” access is designed to assess how to understand the concept of compelling power and what problems arise in practice. Objective of the Bachelor's work: to study the conditions for the fulfillment of obligations in the event of force majeure, identifying the related issues. The main finding of the study is that to default, even if the occurrence of force majeure is not legal. The parties to the contract must either agree on the terms of compelling power or the dispute will be heard by a court, in accordance with the legal framework. The bachelor's work consists of three in the department. The work uses legislation, the knowledge of law scientists, publications on the subject, as well as judgments of the court.
