Abstract
Maģistra darbs “Funkcionēšanas novērtēšanas sistēmas juridiskais raksturojums un pilnveidošanas analīze” ir pētījums, kurā tiek analizēta funkcionēšanas novērtēšanas sistēma gan starptautiskā, gan nacionālā mēroga normatīvo aktu regulējumā, atklājot un norādot uz būtiskiem trūkumiem pašreiz pielietotajā sistēmā, kā arī iesakot, dažāda veida tiesiskus risinājums pacienta un klienta labāko interešu aizsardzībā, veselības aprūpes un sociālās aizsardzības piemērojamo pakalpojumu kontekstā.
Darbā uzmanība pievērsta gan normatīvajos aktos iztrūkstošai terminu vienveidībai, kas attiecīgi rada atšķirīgu ārstniecības personas (ārstējošā ārsta) sniegtā novērtējuma un funkcionālā speciālista viedokli, jo funkcionēšanas novērtēšana skatāma divu nozaru kontekstā – veselības aprūpes un sociālās aizsardzības, tādejādi katrai nozarei piemērojams atšķirīgs regulējums ar tajā ietverto specifisko jēdzienu dažādo saturu, lai arī ar pacientu/klientu saistāmā darbība tendēta un vienāda mērķa sasniegšanu, kur atšķirīgu viedokļu esamība nav pieļaujama.
Maģistra darbs sastāv no ievada, četrām nodaļām, kuras sadalītas apakšnodaļās, kā arī nobeiguma, kurā norādīti darba tapšanas gaitā radušies secinājumu un izteikti priekšlikumi, kā arī izmantotās literatūras saraksta un 2 pielikumiem. Maģistra darbā izmantoti un analizēti starptautiskie un nacionālie tiesību akti, juridiskā literatūra un medicīnas un sociālo pakalpojumu nozarē pielietotās vadlīnijas, medicīniskā literatūra, kā arī elektroniskie resursi. Maģistra darba pievienoto vērtību rada darba autores ilggadēja pieredze minēto regulējuma pielietojumā profesionālajā darbā, to starp, darba procesa gaitā meklējot ne tikai medicīniska, bet arī tiesiska risinājuma rašanas iespējas.
Master's Thesis “Legal description of functional evaluation system and analysis of improvement possibilities” is a study analysing the functioning evaluation (assessment) system in both international and national regulatory frameworks, identifying and pointing to significant shortcomings in the current system, and recommending a different legal solution for protecting the best interests of the patient and client in health care and in the context of the applicable services of social protection. The Thesis focuses on the uniformity of terms that are missing in regulatory enactments, which results in a different opinion from the assessment and Functional specialist provided by the medical practitioner (Treating physician), since the assessment of the functioning is seen in the context of two sectors: health care and social protection, thereby applying a different framework to each sector with the different content of the specific concepts contained therein, even though it can be attributed to patients/customers action to achieve the same objective, where the existence of divergent views cannot be tolerated. The Master's Thesis consists of an introduction, four chapters divided into sub-chapters, as well as a final conclusion in which conclusions and proposals have been drawn up, as well as a list of authorities used and 2 annexes. International and national legislation, legal literature and guidelines in the medical and social services sector, medical literature and electronic resources have been used and analysed in the Master's Thesis. The added value of the Master's Thesis is derived from the long-term experience of the author of the Thesis in applying this regulation to professional work, which, in the course of the work process, looks not only for medical but also for legal solutions.
