Abstract
Bakalaura darbs “Aizliegtas vienošanās publisko iepirkumu jomā” veltīts vienam no konkurences tiesību pīlāriem – aizliegtām vienošanām publiskajos iepirkumos. Latvijā publiskie iepirkumi ir tā vide, kur aizliegtas vienošanās tiek īstenotas visbiežāk. Publiskajā telpā aktualizētie jautājumi norāda uz vairākām būtiskām problēmām publisko iepirkumu norisē, ļaujot secināt, ka publisko iepirkumu procesa mērķis netiek sasniegts korupcijas un konkurences pārkāpumu risku dēļ.
Bakalaura darba mērķis ir izpētīt aizliegtu vienošanos problemātiku publisko iepirkumu jomā, identificējot faktorus, kas veicina aizliegtu vienošanos rašanos, un izpētes rezultātā sniegt ieteikumus normatīvā regulējuma pilnveidošanai aizliegtu vienošanos mazināšanai un prevencijai publiskajos iepirkumos.
Autore savā pētījumā bieži atsaukusies uz Eiropas Savienības un Latvijas tiesu judikatūru un Konkurences padomes lēmumiem. Bakalaura darbs sastāv no 63 lappusēm.
The bachelor paper theme “Prohibited agreements in public procurement” is dedicated to one of three pillars of competition law - prohibited agreements in public procurements. In Latvia, public procurement is the environment where prohibited agreements take place the most. The issues raised in the public space point to a several significant problems in the public procurement process, that allows us to conclude that the aim of the public procurement process is not achieved due to the risks of corruption and competition violations. The aim of the paper is to study the problems of cartels in public procurements, identifying the factors that contribute to the emergence of cartels, and as a result of the research to provide recommendations for improving the regulatory framework for reducing and preventing cartels in public procurement. In the paper there are often analyzed the case law of the courts of the European Union and Latvia and the decisions of the Competition Council of the Republic of Latvia. Study consists of 63 pages.
