Abstract
Maģistra darba mērķis ir izpētīt un analizēt paātrinātā procesa tiesisko regulējumu un piemērošanu Latvijas kriminālprocesa tiesībās. Darbā analizēta paātrinātā procesa būtība, apzināti noziedzīga nodarījuma izmeklēšanas un kriminālvajāšanas teorētiskie un praktiskie aspekti. Ar aptaujas palīdzību autore noskaidro un analizē procesa virzītāju viedokli par paātrināto procesu. Darbā izpētīts ārvalstu tiesiskais regulējums un veikta dažādu saīsināto procesu vēsturiskā un salīdzinošā analīze.
Darbs sastāv no ievada, trim nodaļām – teorētiskās un empīriskās daļas, nobeiguma ar secinājumiem un priekšlikumiem, kā arī pieciem pielikumiem. Izpētījusi tēmu, autore piedāvā diskusijai vairākus problēmjautājumus, kā arī izvirza vairākus priekšlikumus tiesiskā regulējuma un prakses pilnveidošanai. Darba apjoms ar pielikumiem ir 115 lappuses.
The aim of the master's thesis is to study and analyze the legal regulation and application of the accelerated process in Latvian criminal procedure law. The paper analyzes the essence of the accelerated process, identifies the theoretical and practical aspects of criminal investigation and prosecution. With the help of a questionnaire, the author finds out and analyzes the opinion of the process facilitators about the accelerated process. The paper researches foreign legal regulation and performs historical and comparative analysis of various accelerated processes. The paper consists of an introduction, three chapters – theoretical and empirical parts, conclusions and proposals, as well as five appendices. After researching the topic, the author offers several problems for discussion, as well as puts forward several proposals for the improvement of the legal framework and practice. The volume of work with appendices is 115 pages.
