Abstract
The theme of the bachelor's thesis is the right to a fair trial as one of the principles in criminal proceedings. From the point of view of a democratic state governed by the rule of law, one of the most important responsibilities of the state is to ensure effective protection of the fundamental rights and freedoms of individuals. The content of the right to a fair trial includes three mandatory key elements: a fair, independent and impartial court. The right to a fair trial is enshrined in the Constitution of the Republic of Latvia, laws and international legal acts binding on Latvia. The author researched the issues that include the scope of the right to a fair trial, it’s mean, the right of a person to appeal a court decision in a situation where only two instances are provided. Also important is the issue of assessing the criteria of judges' impartiality, especially in situations when a judge re-examines a case in a cassation instance. The aim of the bachelor's thesis is to study the right of persons involved in criminal proceedings to ensure a fair trial, to find out the problems of the legal regulation and to suggest proposals for the improvement of national legal norms. Rights cannot be purely theoretical, they must be practicable. The author studied the mechanism of legal regulation, searched for shortcomings in legal norms and problems of application in the criminal procedure law. In the final part of the bachelor's thesis, the author described the conclusions and developed proposals. The total number of pages of the bachelor's thesis is 60. Keywords: the right to a fair trial, basic principle of criminal proceedings, a fair court, impartial court, independent court.
