Abstract
Bakalaura darba tēma ir “Dzīvokļu īpašnieku kopības lēmumu tiesiskie un praktiskie aspekti”. No tiesiskās noteiktības principa izriet nepieciešamība valstij nodrošināt tiesisko attiecību stabilitāti un noteiktību. Taču praktiski sabiedrības savstarpējas mijiedarbības procesā un attīstībā rodas jaunas sabiedriskās attiecības, kuras ir nepieciešams noregulēt.
Izpētot tiesu praksi tika secināts, ka piemērojot dzīvokļu īpašnieku kopības darbību nosakošo tiesisko regulējumu rodas tādas problēmas, kā neskaidrība tiesisko attiecību subjektu identificēšanā, subjektam piemērojamo noilguma termiņu noteikšanā un faktiskās rīcības rezultātā radīto seku atbildības regulējumā.
Bakalaura darba mērķis ir izpētot un analizējot tiesisko regulējumu noskaidrot, kāda ir ar dzīvokļu īpašnieku kopības lēmumu pieņemšanas procesu saistītā problemātika un, kādi ir šo lēmumu tiesiskie un praktiskie aspekti, kā arī piedāvāt priekšlikumus problēmjautājumu risināšanai un normatīvo aktu pilnveidei.
Pētnieciskās darbības rezultātā tika noskaidrots:
• Ka, lai nodrošinātu ar dzīvokļu īpašnieku kopības darbību radīto seku tiesisko noteiktību, īpaši attiecībā uz dzīvokļu īpašniekiem savstarpēji un uz iesaistītajam trešajām personām ir jāprecizē dzīvokļu īpašnieku kopības statuss normatīvajos aktos.
• Lai risinātu tādus jautājumus, kā dzīvokļu īpašnieku kopības rīcība ar kopējo mantu, normatīvajā regulējumā ir iekļaujamas tiesību normas, kas nosaka mantas sastāvu un kārtību kādā ar mantu var rīkoties.
• Dzīvokļu īpašnieku kopības lēmumu pieņemšanas procesu var padarīt efektīvāku izveidojot mājas lietu Būvniecības informācijas sistēmā, kurā īpašnieki var veikt lēmumu pieņemšanu elektroniski.
• Lai nodrošinātu dzīvojamo māju fizisku saglabāšanu atbilstoši normatīvo aktu prasībām un izvairītos no zaudējumu radīšanas īpašniekiem un trešajām personām, normatīvais regulējums ir papildināms ar tiesību normām, kas regulē finansējuma nodrošināšanu dzīvojamās mājas ārpuskārtas remontam.
Darbs rakstīts latviešu valodā ar kopējo apjomu 57 lapas.
The topic of the bachelor's thesis is "Legal and practical aspects of decision of community of apartment owners". The principle of legal certainty means the need for the state to ensure the stability and certainty of legal relations. But in practice, in the process of the interaction and development of the society, creates new public relations, which need to be regulated. By studying the case law, it was concluded that applying the legal framework that determine the activities of community of apartment owners, occurs such a problems as uncertainty in the identification of the subjects of legal relations, determination of the limitation periods applicable to the subject and regulation of liability for the consequences of actual actions issues. The goal of the bachelor's thesis is by studying and analyzing the legal framework, to find out what are the issues related to the decision-making process of the community of apartment owners, what are the legal and practical aspects of these decisions, as well as to make proposals for solving noted problems and improvement of legal framework. As a result of research activities, it was clarified: • That in order to ensure legal certainty of the consequences of the activities of the apartment owners community, especially with regard to the apartment owners mutually and to the involved third parties, it is necessary to specify the status of the apartment owners community in legal framework. • In order to resolve such issues as the action with apartment owners common property, in legal framework must be determined the property content and the order by which the property can be handled. • The decision-making process of the community of apartment owners can be made more efficient by creating a home file in the Construction Information System, where the owners can make decisions electronically. • In order to ensure the physical preservation of houses in accordance with the requirements of regulatory and to avoid causing looses to owners and third parties, the legal framework must be improved with legal norms that regulate the provision of financing for extraordinary repairs of residential buildings. The work is written in latvian language and consists of 57 pages.
