Abstract
Bakalaura darba tēma ir ‘’Kriminālatbildība par personas apzinātu inficēšanu ar slimību”. Autore uzskata, ka ieteicams apsvērt kriminālatbildību par kaitējumu veselībai, pamatojoties uz Krimināllikuma 133., 133.1 un 134. panta piemēriem. Šī pieeja ir saistīta ar strauju medicīnas progresu infekcijas slimību novēršanā. Darba mērķis ir analizēt normatīvo regulējumu, kas paredz kriminālatbildību par personas apzinātu inficēšanu ar slimību, un tā piemērošanas praksi, kā arī konstatēt iespējamās problēmas un piedāvāt tām risinājumu. Darbā tika analizēts noziedzīga nodarījuma sastāvs un piemērošanas problēmas. Tāpat tiek apskatīti jautājumi, kas saistās ar kriminālatbildības par personas apzinātu inficēšanu ar slimību vēsturisko attīstību, izpētīti terminoloģiskie aspekti. Atsevišķā nodaļā ir apskatīti kriminālatbildības negatīvie aspekti, kas saistīti ar personas apzinātu inficēšanu ar HIV, B, C hepatītu. Analizējot piemērošanas praksi par apzinātu inficēšanu ar slimību Latvijā, nonākot pie secinājuma, ka Latvijas Krimināllikumā nepieciešams veikt grozījumus, lai mazinātu stigmatizāciju un diskrimināciju saistībā ar HIV, B, C hepatītu, mazinātu brīvības atņemšanas termiņu, panākt, lai visi inficēti saņēm atbilstošu terapiju un neatsākas no tas lietošanās. Iepriekš minētie jautājumi ir atspoguļoti un papildināti ar Statistikas datiem no Iekšlietu ministrijas Informācijas centra un Slimības profilakses un kontroles centra.
The theme of the bachelor's thesis is "Criminal liability for deliberate infection of a person with a disease". It is recommended to consider criminal liability for damage to health based on the examples of Articles 133, 133.1 and 134 of the Criminal Law. This approach is associated with rapid medical advances in the prevention of infectious diseases. The aim of the work is to analyze the regulatory framework, which provides for criminal liability for deliberate infection of a person with a disease, and the practice of its application, as well as to identify possible problems and offer a solution to them. The composition of the criminal offense and the problems of its application were analyzed in the work. Issues related to the historical development of criminal liability for deliberate infection of a person with diseases are also considered, and terminological aspects are studied. A separate chapter deals with the negative aspects of criminal liability related to the deliberate infection of a person with HIV, hepatitis B, C. Analyzing the application practice of deliberate infection with the disease in Latvia, it is concluded that the Latvian Criminal Law needs to be amended to reduce stigma and discrimination related to HIV, hepatitis B, C, reduce the term of imprisonment, ensure that all infected receive appropriate treatment and do not resume from its use. The above issues are reflected and supplemented with statistical data from the Information Center of the Ministry of the Interior and the Center for Disease Prevention and Control.
