Abstract
Maģistra darba tēma ir “Tiesības uz informāciju un uz atbildi pēc būtības administratīvajā procesā”. Darba mērķis ir izpētīt vai tiek ievērotas privātpersonu tiesības uz informāciju un uz atbildi pēc būtības administratīvajā procesā, konstatēt problēmjautājumus un piedāvāt iespējamos risinājumus.
Tiesības uz informāciju un uz atbildi ir aktuāls jautājums uz ko norāda personu vēršanās iestādēs un tiesās, pārsūdzot iestāžu atbildes. Darbā ir pētīts kā persona var vērsties iestādē ar iesniegumu, lai saņemtu atbildi. Kādos gadījumos iestāde ir tiesīga nesniegt atbildi vai informāciju. Pētījuma rezultātā secināts, ka ne tikai normatīvais regulējums ir nepilnīgs un tajā nepieciešams veikt grozījumus, bet arī iestādēm ir jādarbojas pēc labas pārvaldības principa, jo nav pieņemami sniegt formālas atbildes vai nenošķirt iesniegumu no informācijas pieprasījuma.
Darbs iedalīts trīs nodaļās ar apakšnodaļām. Kopējais darba apjoms ir 81 lappuse.
The topic of the master's thesis is "The right to information and the right to reply in the administrative process". Goal of the research paper is to study whether the individual’s rights to information and the rights to reply in the administrative process are observed, to identify problem issues and offer possible solutions. The right to information and the answer is a topical issue that is referred by individuals apply to the institutions and the courts, an appeal to the institutions' replies. The paper examines how a person can apply to an institution for an answer. In which cases the institutions entitled not to provide an answer or information? The result of the research is that not only right of superficies is incomplete and necessary to make amendments, but institutions also must act in accordance with the principle of good administration, as it is not acceptable to provide formal answers or not to distinguish the application from the request for information. The paper is divided into three parts with subsections. The thesis contains 81 pages.
