Abstract
Maģistra darbs ir veltīts medicīniska rakstura piespiedu līdzeklim – ambulatorai ārstēšanai. Darbā tiek analizēts sabiedriski bīstamo psihiski slimo personu ārstēšanas regulējums Latvijas teritorijā sākot no 19.gs. līdz mūsdienām; izklāstītas valsts, ārsta un personas attiecības piespiedu ārstēšanas gaitā, aprakstīti personu tiesību un brīvību ierobežojumi, norādīts uz tiesiskā regulējuma trūkumiem, neatbilstību starptautiskajai praksei un standartiem. Secināts, ka medicīniska rakstura piespiedu līdzekļu realizācija ir valsts pārvaldes uzdevums un tas jānodrošina ar valsts iestāžu palīdzību. Izstrādāti priekšlikumi attiecīgo likumu grozījumiem, piedāvātas izmaiņas tiesu praksei.
The master's thesis deals with the compulsory measure of medical nature - outpatient treatment. The paper analyzes the regulation of treatment of socially dangerous mentally ill persons in the territory of Latvia starting from the 19th century and on; outlines the relationship between the state, the doctor and the person in the course of involuntary treatment, describes the restrictions on the rights and freedoms of persons, points out the shortcomings of the legal framework, non-compliance with international practice and standards. It has been concluded that the implementation of coercive measures of a medical nature is the task of the state administration and it must be ensured with the help of state institutions. Proposals for amendments to the relevant laws have been developed, changes in court practice have been proposed.
