Abstract
Maģistra darba “Saskarsmes tiesība un tās realizēšanas problemātika” tēma ir saistīta ar bērnu interešu un tiesību aizsardzības prioritāro raksturu, kas vecāku kopdzīves izbeigšanās rezultātā nereti tiek pārkāptas, jo vecākiem rodas strīds attiecībā uz saskarsmes tiesības realizēšanas kārtību, proti, tās biežumu, ilgumu un saskarsmes tiesības realizēšanas veidu. Normālā situācijā vecākiem par saskarsmes tiesības realizēšanas kārtību būtu savstarpēji jāvienojas ārpustiesas kārtībā, ņemot vērā bērna viedokli, un nosakot tādu saskarsmes tiesības realizēšanas kārtību, kas primāri atbilstu bērna vislabākajām interesēm. Un, tikai galējās nepieciešamības gadījumā, kad visi pārējie pieejamie līdzekļi ir izsmelti, šī jautājuma risināšanai būtu jāiesaistās tiesai. Taču pētījumā gaitā autore nonāca pie secinājuma, ka esošais saskarsmes tiesību reglamentējošai normatīvais regulējums neveicina strīda risināšanu ārpustiesas kārtībā, kā arī ar to netiek sasniegts saskarsmes tiesības institūta mērķis - padarīt saskarsmi starp bērnu un vecāku pēc iespējas efektīvāku un realizējamāku, jo, gan saskarsmes tiesības izmantošanas kārtības noteikšanas process, gan arī saskarsmes tiesības realizēšanas process tiek nepamatoti novilcināts, pastāvot zināmiem šķēršļiem nepilnīga tiesiska regulējuma dēļ. Tādējādi, maģistra darba mērķis ir, izpētot saskarsmes tiesību un tās realizēšanas tiesisko regulējumu un praksi, konstatēt problēmas un ieteikt to risinājumus. Maģistra darbs sastāv no trīs nodaļām. Maģistra darba kopējais lapaspušu skaits ir 77.
The subject of the Master's paper “Access rights and problems of Its realization” is related to the priority nature of the protection of children's interests and rights, which is often infringed by the termination of parental cohabitation, as parents have a dispute over the modalities for realization the access rights, namely its frequency, duration and the way in which the access rights is used. In normal circumstances, parents should be mutually agreed on out-of-court arrangements for using the access rights, according to the views of the child, and establishing procedures for using the access rights that would primarily correspond to the best interests of the child. And, only in the case of extreme necessity, where all the other means available have been exhausted, the court should be involved in this matter. However, in the course of the study, the author came to the conclusion that the existing regulatory framework for the access rights does not contribute to the out-of-court settlement of the dispute, nor does it achieve the aim of the Institute of Access rights - to make contact between the child and the parent as effective and practicable as possible, since both the process of determining the usage of procedures for access rights and the process of access rights realization is unduly delayed by certain obstacles due to a lack of full legal framework. Thus, the aim of the Master's paper is to identify problems and suggest solutions by researching the legal regulation and practice of access rights and its realization. The Master's paper consists of three chapters. The overall number of pages in the Master's paper is 77.
