Abstract
Cīņā pret sveša īpašuma piesavināšanos svarīga loma ir krimināltiesiska rakstura pasākumiem, kas nosaka atbildību par mantas piesavināšanos. Krimināllikumā piesavināšana ieņem īpašu vietu, tā ir sadalīta atsevišķā sastāvā, un tai piemīt noteiktas pazīmes. Kriminālatbildība par šo noziedzīgo nodarījumu ir paredzēta Latvijas Krimināllikuma 179. pantā, kur tiek noteikts, ka piesavināšanās ir nelikumīga svešas mantas iegūšana vai izšķērdēšana, ko izdarījusi persona, kurai šis īpašums ticis uzticēts vai kuras jurisdikcijā tā bijusi.
Piesavināšanās no kopējā noziedzīgu nodarījumu skaita veido vidēji 28 % no visiem reģistrētajiem noziedzīgajiem nodarījumiem valstī, turklāt ar tendenci pēdējo trīs gadu laikā procentuāli pieaugt. Līdz ar to rodas jautājums, kas izraisa noziedzīgu nodarījumu, kas izpaužas kā piesavināšanās, pieaugumu un vai, ņemot vērā krimināllietu skaitu, kurās iesaistītas valsts amatpersonas un maksātnespējas administratori, noziedzīgam nodarījuma, kas noteikts Krimināllikuma 179.pantā nav nepieciešams paredzēt speciālā subjektu papildapstākli, gadījumā, ja noziedzīgo nodarījumu ir veikusi amatpersona, pildot dienesta pienākumus?
Bakalaura darba mērķis ir raksturot Krimināllikuma 179.panta - piesavināšanās kvalifikācijas problemātiku analizējot piemērošanas nosacījumus, pēc kā izstrādāt iespējamos risinājumus, lai novērstu problēmas, kas saistītas ar piesavināšanas kvalifikācijas piešķiršanu.
Attiecīgi, darba uzdevumi mērķa sasniegšanai ir šādi: izpētīt piesavināšanās jēdzienu un vēsturisko attīstību; veikt piesavināšanās pamatsastāva analīzi; pievērst uzmanību jautājumiem, kas saistīti ar piesavināšanas norobežošanu no citām saistītām noziedzīgām darbībām; veikt piesavināšanās tiesu prakses analīzi.
Darbs sastāv no ievada, 3 (trīs nodaļām) un nobeiguma.
Kopējais darba apjoms ir 59 lappuses.
Measures of a criminal nature, which determine the responsibility for the misappropriation of property, play an important role in the fight against the misappropriation of another's property. In criminal law, embezzlement has a special place, it is divided into a separate composition, and it has certain characteristics. Criminal liability for this criminal offense is provided for in Article 179 of the Latvian Criminal Law, which stipulates that embezzlement is the illegal acquisition or waste of another's property by a person to whom this property has been entrusted or under whose jurisdiction it has been. Embezzlement accounts for an average of 28% of all registered crimes in the country, with an upward trend over the last three years. Consequently, a question arises which causes an increase in criminal offenses in the form of embezzlement and whether, given the number of criminal cases involving public officials and insolvency administrators, it is not necessary to provide an additional special circumstance for an offense specified in Section 179 of the Criminal Law if the offense was committed by an official in the performance of his duties? The aim of the bachelor's thesis is to describe the problem of embezzlement qualification in Section 179 of the Criminal Law by analyzing the conditions of application, after which to develop possible solutions to prevent problems related to the award of embezzlement qualification. Accordingly, the tasks of the work to achieve the goal are as follows: to study the concept of embezzlement and its historical development; to analyze the essence of embezzlement as one of the ways of interpretation of theft; to perform an analysis of the basic composition of misappropriation; to address issues related to the segregation of embezzlement from other related criminal activities; to analyze the practice of embezzlement courts. The work consists of an introduction, 3 (three chapters) and a conclusion. Total paper volume is 59 pages.
