Abstract
Bakalaura darba temats ir “Izmeklēšanas tiesnesis kriminālprocesā”.
Latvijas kriminālprocesuālajās tiesībās 2005.gada 1.oktobrī stājās spēkā jauna tiesību institūta – izmeklēšanas tiesneša – regulējums, kura galvenais uzdevumus ir kontrole pār cilvēktiesībām pirmstiesas kriminālprocesā.
Gan Latvijas Republikas Satversmē, gan Starptautiskajos tiesību aktos tiek garantētas cilvēktiesības, taču tās nav absolūtas un nepieciešamības gadījumā var tikt ierobežotas, lai aizsargātu citu cilvēku tiesības. Izmeklēšanas tiesneša galvenā funkcija ir kontrolēt cilvēktiesību ievērošanu pirmstiesas kriminālprocesā, kā arī pirmās instances tiesā līdz iztiesāšanas uzsākšanai, neļaujot nepamatoti ierobežot cilvēka pamattiesības.
Bakalaura darbā tiks noskaidrots, vai apstiprinās hipotēze – izmeklēšanas tiesneša tiesību un pienākumu kriminālprocesuālais regulējums nav pietiekams, lai ātri un efektīvi pabeigtu pirmstiesas kriminālprocesu.
Izstrādājot bakalaura darbu, autore apskatīs dažādu autoru viedokļus par izmeklēšanas tiesneša kompetenci un pilnvarām pirmstiesas kriminālprocesā un pirmās instances tiesā līdz iztiesāšanas uzsākšanai. Darba izstrādes gaitā autore pētīs Latvijas Republikas Satversmi, Kriminālprocesa likumu un citus normatīvos aktus, kā arī tiks apskatīta Eiropas Cilvēktiesību tiesas judikatūra.
Bakalaura darba mērķis ir analizēt izmeklēšanas tiesneša institūta nozīmi kriminālprocesā, tā vēsturisko attīstību, identificēt problēmas un sniegt iespējamos risinājumus izmeklēšanas tiesneša institūta pilnveidošanai nākotnē.
Bakalaura darbs sastāv no ievada, četrām nodaļām, septiņām apakšnodaļām un nobeiguma.
Pirmās nodaļas ietvaros autore apskata izmeklēšanas tiesneša institūta jēdziena saturu.
Otrā nodaļa “Izmeklēšanas tiesneša institūta izcelsme un vēsturiskā attīstība” ir sadalīta divās apakšnodaļās. Pirmajā apakšnodaļā tiek aprakstīta izmeklēšanas tiesneša institūta attīstība Latvijā, savukārt otrajā apakšnodaļā – izmeklēšanas tiesneša institūta attīstība citās valstīs.
Trešā nodaļa “Izmeklēšanas tiesneša kompetence un pilnvaras pirmstiesas kriminālprocesā” ir sadalīta piecās apakšnodaļās. Pirmajā apakšnodaļā autore apskata procesuālo piespiedu līdzekļu piemērošanu, otrajā apakšnodaļā – izmeklēšanas darbību atļaušanu, trešajā apakšnodaļā – speciālo izmeklēšanas darbību atļaušanu, ceturtajā apakšnodaļā – sūdzību izskatīšanu un piektajā apakšnodaļā – citas darbības, ko veic izmeklēšanas tiesnesis pirmstiesas kriminālprocesā.
Ceturtajā nodaļā tiek apskatīta izmeklēšanas tiesneša kompetence un pilnvaras pirmās instances tiesā līdz iztiesāšanas uzsākšanai.
Bakalaura darba kopējo lappušu skaits ir 67.
The subject of the bachelor thesis is "The Investigating Judge in Criminal Proceedings". On 1 October 2005, a new legal institution - the investigating judge - came into force in Latvian Criminal procedural law, the main task of which is to control human rights in pre-trial criminal proceedings. Both the Constitution of the Republic of Latvia and international law guarantee human rights, but they are not absolute and may be limited where necessary to protect the rights of others. The main function of the investigating judge is to monitor respect for human rights in pre-trial criminal proceedings, as well as in the court of first instance pending trial, preventing unjustified restrictions on fundamental human rights. The bachelor thesis will investigate whether the hypothesis - the criminal procedural regulation of the rights and duties of the investigating judge is not sufficient for a quick and efficient completion of pre-trial criminal proceedings - is confirmed. In the bachelor thesis the author will examine the views of various authors on the competence and powers of the investigating judge in pre-trial criminal proceedings and in the court of first instance until the commencement of the trial. In the course of the thesis the author will study the Constitution of the Republic of Latvia, the Criminal Procedure Law and other normative acts, as well as the case law of the European Court of Human Rights. The aim of the bachelor thesis is to analyse the role of the institution of the investigating judge in criminal proceedings, its historical development, identify problems and provide possible solutions for the future improvement of the institution of the investigating judge. The thesis consists of an introduction, four chapters, seven sub-chapters and a conclusion. In the first chapter, the author examines the content of the concept of the institution of the investigating judge. The second chapter, 'The origin and historical development of the institution of the investigating judge', is divided into two sub-chapters. The first subsection describes the development of the institution of the investigating judge in Latvia, while the second subsection describes the development of the institution of the investigating judge in other countries. Chapter 3, 'Competence and powers of the investigating judge in pre-trial criminal proceedings', is divided into five sub-chapters. In the first subsection, the author deals with the application of procedural coercive measures, in the second subsection with the authorisation of investigative measures, in the third subsection with the authorisation of special investigative measures, in the fourth subsection with the examination of complaints and in the fifth subsection with other actions taken by the investigating judge in pre-trial criminal proceedings. Chapter 4 deals with the competences and powers of the investigating judge in the court of first instance pending the trial.
