Abstract
Personas dati un to aizsardzība ir viena mūsdienu ievērojamākajām aktualitātēm, īpaši ņemot vērā straujo tehnoloģiju attīstību, kad ne tikai būtiski palielinājies apstrādāto datu apjoms, bet ir radušies arī jauni riski, kurus nepieciešams novērst, izstrādājot atbilstošu normatīvo regulējumu un ieviešot atbilstošus drošības pasākumus.
Veicot šī brīža spēkā esošo normatīvo aktu analīzi attiecībā pret aktualitātēm un nepieciešamībām veselības jomā konstatēts, ka šī brīža regulējums nav pilnvērtīgs, līdz ar to, praksē rodas vairāki sarežģījumi nepilngadīgu pacientu personas datu aizsardzības nodrošināšanā.
Pētījuma mērķis ir izpētīt praksē pastāvošās problēmas saistībā ar nepilngadīga pacienta personas datu aizsardzību veselības jomā un sniegt priekšlikumus normatīvā regulējuma pilnveidošanai.
Darba ietvaros ir pētīti jautājumi saistībā ar nepilngadīgas personas kā datu subjekta tiesību un interešu ievērošanas aspektiem veselības aprūpē. Tiks piedāvāti priekšlikumi procesa uzlabošanai, salīdzinot Latvijas normatīvo regulējumu un praksi ar ārvalstu.
Pētījuma rezultātā autore nonāks pie secinājumiem, ka praksē pastāv dažādas problēmas veicot nepilngadīgu pacientu personas datu apstrādi. Turklāt nepilnību regulējumā rezultātā, arī medicīnas jomā pastāv ļoti atšķirīga prakse. Autore sniegs personīgu ieskatu konstatēto problēmu risinājumam.
Personal data protection is one of the most significant issues today, especially because of the rapid development of technology, when not only the amount of processed data has significantly increased, but new risks has emerged that need to be addressed by developing appropriate regulations and implementing appropriate security measures. Analyzing the current regulatory enactments in relation to current events and needs in the field of healthcare, it has been established that the current regulation is not complete, thus, in practice, several difficulties arise in ensuring the protection of personal data of minor patients. The aim of the thesis is to study the existing problems related to the protection of personal data of a minor patient in the field of health and to provide proposals for the improvement of the regulatory framework. Within the framework of the thesis, issues related to the aspects of respect for the rights and interests of a minor as a data subject in health care have been studied. Proposals for improving the process by comparing Latvian regulations and practices with foreign ones will be offered. As a result of the thesis, the author concludes that in practice there are various problems in processing the personal data of minor patients. In addition, because of regulatory shortcomings, there are also very different practices in the field of medicine. The author will provide a personal insight into the solution of the identified problems.
