Abstract
Bakalaura darbs “Korupcijas riski būvniecībā un to novēršana” izstrādāts, lai identificētu nozīmīgākās problēmas pasūtītāja un piegādātāja tiesiskajās attiecībās, kas rada riskus prettiesiskai rīcībai un korupcijai. Tēma savu aktualitāti ieguvusi pēc 2021. gadā atklātās karteļa vienošanās būvniecības nozarē, kas veiksmīgi darbojās gan publiskajā, gan privātajā būvniecībā vairākus gadus, nodarot zaudējumus visai būvniecības nozarei.
Darba mērķis: izpētot publiskā iepirkuma tiesisko regulējumu būvniecības nozarē, konstatēt tā trūkumus un piemērošanas problemātiku, kas rada korupcijas riskus, ierosināt izmaiņas būvdarbu publiskā iepirkuma procesa uzlabošanai un uzraudzīšanai, risku novēršanai.
Darbā pētīts būvniecības publiskā iepirkuma tiesiskais regulējums, tā piemērošanas problemātika, nozīmīgākie korupcijas riski iepirkuma procesā, kā arī iepirkuma līguma izpildes procesā un izteikti priekšlikumi to novēršanai.
Autore kā nozīmīgāko secinājumu min to, ka ļoti daudz resursu tiek veltīti būvniecības iepirkumu uzraudzībai, kuru līgumsumma pārsniedz 170 000 EUR, cenšoties novērst tajos visus potenciālos korupcijas riskus, taču lielākā daļa būvniecības iepirkumu publiskajā sektorā tiek veikti nepārsniedzot 170 000 EUR slieksni, tādējādi iepirkumi tiek veikti Publisko iepirkumu likumā noteiktā atvieglotā kārtībā, savukārt šo iepirkumu uzraudzība netiek veikta vai noris ļoti virspusēji, tā neiegūstot informāciju par lielāko daļu iepirkumu procedūru tiesiskumu un objektivitāti.
Bakalaura darbs sastāv no 49 lapām un izmantoto avotu un bibliogrāfijas saraksta.
The bachelor's thesis “Corruption risks in construction and their prevention” is designed to identify the most significant problems in the legal relationship between the customer and the supplier, which pose risks to illegal actions and corruption. The topic gained its relevance after the cartel agreement in the construction sector opened in 2021, which operated successfully in both public and private construction for several years, causing losses to the entire construction sector. Aim of the work: by studying the legal regulation of public procurement in the construction sector, to identify its shortcomings and application problems that cause corruption risks, to propose changes to improve and monitor the public procurement process of construction works and to prevent risks. Work covers legal regulation of construction public procurement, problems of its application and greatest corruption risks in procurement process, as well as in procurement contract execution process. Proposals for corruption risk mitigation were made. The author mentions as the most important conclusion that a lot of resources are devoted to the supervision of construction procurement, the contract amount of which exceeds 170,000 EUR, trying to eliminate all potential corruption risks, but most construction procurements in the public sector are below the 170,000 EUR threshold. Performed in accordance with the simplified procedure specified in the Public Procurement Law, while the supervision of these procurements is not performed or is carried out very superficially, thus not obtaining information on the legality and objectivity of most procurement procedures. The bachelor's thesis consists of 49 pages and a list of sources and bibliography.
