Abstract
Bakalaura darba tēma ir - Īpašuma tiesību uz nekustamo īpašumu nostiprināšana zemesgrāmatā. Autore izvēlējās šo tēmu, jo jau kopš zemesgrāmatu darbības atjaunošanas, Latvijā nepārtraukti notiek nekustama īpašuma tirgus attīstība, lai gan dažos posmos tā ir novērojama straujāka, bet citos lēnāka. Par to liecina arī statistikas dati. Salīdzinot 2019. gada decembra mēneša ar 2020. gada janvāra mēneša datiem, Rīgā piedāvāto dzīvokļu apjoms ir palielinājies par 33%. Bet, ja salīdzina 2019. gada janvāra ar šī gada janvāra datiem, tad pieaugums ir novērojams vairāk kā 3% apmērā. Tiesiskā regulējuma praktiskās piemērošanas un tiesu prakses izpētes un analīzes rezultātā, autore ir konstatējusi vairākas problēmas: viena no tām ir saistīta ar nekustamā īpašuma nostiprināšanas zemesgrāmatā termiņu neesamību. Nav noteiktības vai tiesiskais darījums ir noslēdzams privātā kārtā vai notariāla akta veidā. Kā arī tiesā iesniegtie nostiprinājuma lūgumi bieži tiek atstāti bez ievērības, biežākais iemesls tam ir iesniegts nekorekts nostiprinājuma lūgums.
Darba mērķis ir īpašuma tiesību uz nekustamo īpašumu nostiprināšanu zemesgrāmatā tiesiskā regulējuma, praktiskās piemērošanas un doktrīnas izpētes un analīzes rezultātā izdarīt secinājumus un sniegt priekšlikumus Latvijas Republikas tiesiskā regulējuma pilnveidošanā.
Darba ir izdarīti secinājumi un sniegti priekšlikumi uz augstāk minētajām un citām problēmām, kā arī ir arī sniegtas atbildes uz darba ievadā izvirzītajiem pētījuma jautājumiem. Bakalaura darba kopējais apjoms ir 51 lpp.
The subject of this bachelor thesis is - Consolidation of property rights in the Land Register. The topic was chosen because, since the restoration of land registers, the real estate market in Latvia has been constantly developing, with different speed through the times. This is also evidenced by statistics. Comparing the data of December 2019 with the data of January 2020, the amount of apartments offered in Riga has increased by 33%. However, if we compare January 2019 with the data of January this year, then the increase is observed by more than 3%. As a result of the practical application of the legal framework and research and analysis of court practice, the author has identified several problems. One of them is related to the lack of deadlines for the registration of real estate in the Land Register. Also, it is uncertain whether the legal transaction has to be concluded in private or in the form of a notarial deed. As well as requests for confirmation submitted to the court are often ignored. The most common reason for this is incorrectly submitted strengthening confirmation request. The aim of the work is to draw conclusions and make proposals for the improvement of the legal regulation of the Republic of Latvia as a result of author's research and analysis of the legal regulation, practical application, and doctrine of strengthening the property rights to real estate in the Land Register. The paper draws conclusions and provides suggestions on the above mentioned and other problems. As well as provides answers to the research questions raised in the introduction. The total volume of the bachelor's thesis is 51 pages.
