Abstract
Izvēlētā maģistra darba tēma ir “Darba un dienesta tiesisko attiecību izbeigšana nodarbinātajam atrodoties alkohola un citu vielu reibuma vai ietekmes dēļ”. Nodarbinātības pienākumu veikšana alkohola vai citu vielu reibumā vai ietekmē būtiski apdraud gan nodarbinātā, gan citu personu drošību, veselību un pat dzīvību, kā arī var ietekmēt darba devēja reputāciju. Būtiski ir tas, ka likumdevējs normatīvajos aktos nav regulējis alkohola un citu vielu “reibuma” vai “ietekmes” jēdzienus, kā rezultātā rodas normu piemērošanas problemātika, kas atspoguļojas tiesu praksē.
Autore darbā analizēja reibuma jēdzienu, salīdzināja attiecīgo nodarbinātības tiesisko regulējumu Baltijas valstīs, kā arī analizēja tiesu praksi darba un dienesta tiesiskajās attiecībās.
Darba mērķis bija, izpētot ar nodarbinātības tiesiskajām attiecībām saistītos normatīvos aktus, literatūru un tiesu praksi, konstatēt jēdzienu “reibums” un “ietekme” piemērošanas problēmas un izstrādāt priekšlikumus.
Autore secināja, ka ir nepieciešami atsevišķu normu grozījumi un papildinājumi Darba likumā, atbilstoši Dienesta gaitas likuma normai, lai nodrošinātu drošu darba vidi. Tā kā pārsvarā nodarbinātajiem tiek konstatēta alkohola klātbūtne organismā, nepieciešams arī papildināt normu ar konkrētu alkohola reibuma gradācijas pakāpi, lai izskaustu jēdzienu piemērošanas problemātiku un skaidrāk noregulētu konkrēto nodarbinātības jomu.
Maģistra darba kopējais apjoms ir 73 lapas.
The chosen topic of the master thesis is "Termination of a contract of employment due to the employee, when performing work, being under the influence of alcohol or other intoxicating substances". Performing employment duties under the influence of alcohol or other intoxicating substances possess a significant threat to the safety, health and even life of both the employee and other persons, and may affect the reputation of the employer. It is important that the legislator has not regulated the concepts of "intoxication" nor "influence" of alcohol and other substances in regulatory enactments, as a result of which the problem of application of legal norms arises, which is reflected in judicial practice. In master thesis, the author analysed the concept of intoxication, compared the relevant legal regulations of employment in the Baltic States, as well as analysed the case law in labour and service law legal relations. The aim of the thesis was to identify the problems of application of the concepts of "intoxication" and to develop proposals by studying the regulatory enactments, literature and court practice related to employment legal relations. The author concluded that certain amendments and additions to the Labour Law are necessary, in accordance with the legal norms, in order to ensure a safe working environment. As most employees, who are found intoxicated at a workplace, have been under the influence of alcohol, it is also necessary to adjust the norm with a certain scale of alcohol intoxication levels
