Abstract
Maģistra darba “Uzturlīdzekļu piedziņa par labu bērnam un to problemātika Latvijā” pētījuma mērķis ir izpētīt uzturlīdzekļu bērniem maksāšanas pienākuma tiesisko regulējumu, konstatēt problemātiku, kuras rezultātā nepietiekami tiek nodrošinātas bērna tiesības saņemt uzturlīdzekļus, un sniegt priekšlikumus tiesiskā regulējuma pilnveidošanai.
Pētījums veikts, lai izpētītu un analizētu uzturlīdzekļu piedziņas prasījumus atbilstoši likumdošanas normām un praktiskajos jautājumos radušās problēmas.
Autore ir aprakstījusi praksi tiesā, Uzturlīdzekļu garantiju fonda nozīmi un zvērinātu tiesu izpildītāju darbību lomu uzturlīdzekļu piedziņā.
Autore ir izstrādājusi priekšlikumus par iespējamajiem ātrākajiem bērnu uzturlīdzekļu piedziņas nodrošināšanas veidiem, lai vienkāršotu uzturlīdzekļu piedziņas procedūru.
Tika izmantotas šādas datu vākšanas metodes: literatūras, juridisko dokumentu, publikāciju, interneta avotu, novērojumu un tiesu prakses materiālu analīze.
Maģistra darba kopējais apjoms ir 84 lapaspuses, bez pielikumiem.
The aim of the Master's thesis "Recovery of Child Support and its Problems in Latvia" is to study the legal regulation of the obligation to pay child support, to identify the problems which result in insufficient provision of the child's right to receive child support, and to provide proposals for improvement of the legal regulation. The study was carried out in order to investigate and analyse the maintenance claims under the legislative provisions and the problems arising in practical matters. The author has described the practice in court, the role of the Maintenance Guarantee Fund and the role of bailiffs in the recovery of maintenance. The author has made proposals on the quickest possible ways of securing child maintenance in order to simplify the procedure for recovery of maintenance. The following data collection methods were used: analysis of literature, legal documents, publications, internet sources, observations and case law. The total length of the Master's thesis is 84 pages, without annexes.
