Abstract
Maģistra darba tēma ir “Publisko iepirkumu komisijas darbības tiesiskā regulējuma
pilnveides iespējas”. Maģistra darbā ir pētītas aktuālās problēmas un konstatētas nepilnības
Latvijas normatīvajos aktos, padziļināti vēršot uzmanību un pētot iepirkumu komisijas darbību un
identificēt iespējamos riskus tās darbībā. Pētnieciskajā darbā ir pētīts tiesiskais regulējums, kā arī
raksturotas praksē pastāvošās problēmas, piedāvājot risinājumus šo problēmu novēršanai.
Maģistra darba mērķis ir padziļināti izpētīt šobrīd esošās problēmas publisko iepirkumu
komisijas darbībā, atklāt šo problēmu cēloņus un sniegt problēmu risinājumus ar konkrētiem
priekšlikumiem, lai iespējami efektīvi nākotnē varētu izvairīties no šīm pastāvošajām problēmām
un nepilnībām. Autore ir salīdzinājusi un izanalizējusi dažādu autoru darbus, izpētījusi nacionālo
un starptautisko tiesu praksi, kā arī zinātniskos avotus saistībā ar publisko iepirkumu komisijas
darbību. Darba izstrādes gaitā autore ir nonākusi pie vairākiem problēmjautājumiem un no tiem
izrietošiem secinājumiem. Darba noslēgumā ir norādīti secinājumi, kā arī priekšlikumi publisko
iepirkumu komisijas darbības pilnveidei. Maģistra darbs sastāv no četrām nodaļām.
Pirmajā nodaļā “Publisko iepirkumu jēdziens, pamatprincipi un tiesiskie aspekti”, autore
aplūkos publisko iepirkumu tiesisko regulējumu un tā principus. Nodaļas beigās autore sniegs
priekšlikumus tiesiskā regulējuma pilnveidošanai.
Otrajā nodaļā “Interešu konflikti un citi riski iepirkumu komisijas darbībā”, autore izpētīs
nepilnības iepirkumu komisijas darbībās, kuras saistītas ar favorītismu un interešu konflikta
riskiem. Tiks skatīta iepirkumu komisijas izveides un tās darbības problemātika, analizētas un
raksturotas iepirkuma komisijas funkcijas un nepieciešamā kompetence. Nodaļas beigās autore
sniegs priekšlikumus iepirkuma komisijas darbības tiesiskā regulējuma pilnveidošanai.
Trešajā nodaļā “Konkursa dokumentācijas izveide”, autore pētīs nepilnības konkursa
nolikumu izveidē un iekļautajā dokumentācijā, un piedāvās risinājumus.
Ceturtā nodaļā “Lēmumu apstrīdēšana un pārsūdzēšana”, autore noskaidros kādi ir
pārsūdzēšanas un apstrīdēšanas mehānismi nacionālajos normatīvajos aktos, vērtēs to atšķirības un
sniegs priekšlikumus to pilnveidei. Maģistra darbs sastāv no 88 lapaspusēm.

The topic of the master’s thesis is "Opportunities for Improvement in the legal framework of the Public Procurement Commission". The master’s thesis examines the current problems and the identified gaps in the Latvian regulatory acts, focusing and studying in depth the activities performed by the Public Procurement Commission and identifying possible risks in its activities. The research examines the legal framework, as well as describes the problems that exist in practice, proposing solutions to eliminate these problems. The aim of the master’s thesis is to study in depth the current problems in the activities of the Public Procurement Commission, to identify the causes of these problems and to provide solutions with concrete proposals in order to avoid these existing problems and shortcomings as efficiently as possible in the future. The author has compared and analysed the works of various authors, studied national and international case law, as well as scientific sources related to the activities of the Public Procurement Commission. In the course of the research, the author has identified a number of challenges and come to conclusions arising from these challenges. The conclusion of the paper consists of the research findings, as well as proposals on how to improve the activities of the Public Procurement Commission. The master’s thesis consists of four chapters. In the first chapter, “The Concept, Principles and Legal Aspects of Public Procurement”, the author will look at the legal framework of public procurement, as well as its principles. At the end of the chapter, the author will make proposals for the improvement of the legal framework. In the second chapter, “Conflicts of interest and related risks of the Public Procurement Commission actions”, the author will explore the weaknesses in the activities of the Public Procurement Commission related to favouritism and the risks of conflict of interest. The problems in the establishment of the Procurement Commission, as well as its current activities, will be examined, and the functions and necessary competences of the Procurement Commission will be analysed and described. At the end of the chapter, the author will make proposals for the improvement of the legal framework of the Procurement Commission. In the third chapter “Creation of tender documentation”, the author will explore the shortcomings in the creation and documentation of tendering rules and propose solutions. In the fourth chapter “The decision appealing and challenging”, the author will identify the mechanisms of appealing and challenging in national laws and regulations, assess their differences and make proposals for their improvement.
