Abstract
Bakalaura temats ir “Paternitātes noteikšana un apstrīdēšana”. Darbs sniedz ieskatu par paternitātes noteikšanu un apstrīdēšanu. Darbā tiek pētīts jautājums par to, kā nodrošināt bioloģiskā tēva tiesību aizsardzību uz paternitātes noteikšanu un apstrīdēšanu, ja bērna intereses ir primāras visās darbībās, kas skar bērnu. Pētījuma mērķis bija izpētīt paternitātes tiesisko regulējumu un tā piemērošanu, konstatēt problēmas, kas saistītas ar bioloģiskā tēva tiesībām uz cita vīrieša pieņemto vai atzīto paternitātes apstrīdēšanu un ieteikt iespējamos risinājumus. Darbā tiek secināts, ka bērna bioloģiskajam tēvam ir diezgan ierobežotas tiesības uz citas personas pieņemto vai atzīto paternitātes apstrīdēšanu. Lai garantētu skaidru, vienlīdzīgu un taisnīgu tiesību aizsardzību visām iesaistītām personām, būtu jāgroza dažas Civillikuma un Civilprocesa likuma tiesību normas. Tiesiskā regulējuma konstatētām nepilnībām un pretrunām autore ir sniegusi priekšlikumus. Darba kopējais lappušu skaits ir 52.
The Bachelor's thesis is “Establishing and contesting paternity”. The bachelor provides an insight into establishment and contestation of paternity. The study explores the question of how to ensure the protection of the biological father's right to establish and contest paternity when the best interests of the child are the primary consideration in all actions affecting the child. The aim of the study was to explore the legal framework of paternity and its implementation, to identify the problems related to the right of a biological father to appeal against the paternity accepted or recognised by another man and to suggest possible solutions. The study finds that the biological father of a child has a rather limited right to contest paternity accepted or recognised by another person. In order to guarantee a clear, equal and fair protection of the rights of all the parties involved, amendments should be made to certain articles of the Civil Law and the Civil Procedure Law. The author has made recommendations to address the gaps and inconsistencies identified in the legal framework. The total number of pages is 52.
