Abstract
Kopfinansējuma pakalpojums 2008.gada finanšu krīzes iespaidā, kā arī finanšu tehnoloģiju attīstības rezultātā ir kļuvis par aktuālu un ar vien biežāk izmantotu alternatīvā finansējuma piesaistes instrumentu.
Straujā kopfinansējuma pakalpojuma attīstība ir izraisījusi daudz jautājumu saistībā ar speciāla tiesiskā regulējuma nepieciešamību, lai sabalansētu visu trīs kopfinansējuma pakalpojumā iesaistīto subjektu intereses. Interneta vides funkcionalitāte un vispārējā pieejamība ir padarījusi kolektīvo finansēšanu daudz vienkāršāku un plašākai sabiedrībai pieejamāku
Maģistra darba mērķis ir sagatavot pētījumu par kopfinansējuma pakalpojumā iesaistīto subjektu tiesisko attiecību problemātiku un izstrādāt priekšlikumus tiesiskā regulējuma pilnveidei.
Maģistra darbu veido ievads, četras pamatdaļas, kas ir sadalītas vairākās nodaļās un apakšnodaļās, nobeigums (secinājumi un priekšlikumi) un izmantotās literatūras un avotu saraksts.
Maģistra darba struktūra ir izvēlēta, lai loģiski un secīgi atklātu ar kopfinansējuma pakalpojuma jomu saistītā tiesiskā regulējuma problemātiku.
Pamatojoties uz tiesību aktu, tiesu prakses, judikatūras kā arī zinātnisko avotu teorētisko analīzi un pētījumā iegūtajiem empīriskajiem rezultātiem, ir izdarīti secinājumi un izteikti priekšlikumi, kas ietverti maģistra darba nobeigumā.
The start of the global financial crisis of 2008 and the post-crisis period jumpstared the search for new, alternative ways to fund various innovations and projects. The rapid development of the crowdfunding has raised many questions regarding the need for a special legal framework to balance the interests of all three parties involved in the crowdfunding service. The functionality and general availability of the Internet has made crowd funding models far simpler to construct and to bring to the attention of the general public. The aim of the master’s thesis is to prepare a study on the problems of legal relations between the parties involved in the crowdfunding sector and develop proposals for the improvement of the legal framework. The master’s thesis is comprised of an introduction, four basic chapters further divided into several sections and subsections, closing (conclusions and recommendations) and a list of reference literature used. Structure of the thesis is chosen for a purpose to logically and consequently disclose problems related to legal framework regarding crowdfunding in Latvia. Based on theoretical analysis of laws and regulations, case law, jurisprudence as well as theoretical analysis of scientific source literature and empiric findings obtained during the research, conclusions have been drawn and recommendations have been made that are outlined in the closing of the master’s thesis.
