Abstract
Darba nosaukums: Atbildība par nepilngadīgu personu izdarītajiem administratīvajiem pārkāpumiem
Studiju darba apjoms: 63 lpp., 64 literatūras avoti.
Temata aktualitāte: Administratīvie pārkāpumi, ar tiem saistītās nianses un par tiem paredzētie sodi un/vai atbildība ir un paliek aktualitātes ietvaros, jo, kā pieaugušām, tā arī nepilngadīgām personām sanāk veikt administratīvus pārkāpumus. Pēc Administratīvās atbildības likuma, kas stājies spēkā salīdzinoši nesen, bērnu vecuma dēļ, viņiem paredzētie sodi un/vai atbildība ir maigāki – neskaitot administratīvo atbildību, pastāv arī audzinoša rakstura piespiedu līdzekļi. Tomēr, jau vairākus gadus pastāv Tiesībsarga norādījumi, ka amatpersonas nepamatoti piemēro administratīvos sodus, neņemot vērā audzinoša rakstura piespiedu līdzekļu piemērošanas prioritāti. Tas ievērojams un pētāms arī izmaiņu pirms un pēc Administratīvās atbildības likuma spēkā stāšanās kontekstā.
Pētījuma mērķis: Analizējot par nepilngadīgu personu izdarīto administratīvo pārkāpumu paredzētās atbildības tiesisko regulējumu, izpētīt un aprakstīt problēmas, kas rodas likumu pielietojot, kā arī problēmas, kas rodas Administratīvās atbildības likuma normās paredzētās atbildības veidu prioritāti neievērojot.
Pētījumā iegūtie rezultāti: Pētījuma gaitā tika izanalizēta un izpētīta zinātniskā literatūra un tiesību akti par atbildības par nepilngadīgu personu izdarītajiem administratīvajiem pārkāpumiem tiesisko regulējumu, tā vēsturiskā ģenēze, kā arī tā problemātika mūsdienās.

Topicality: Violations of administrative regulations, related nuances and the penalties and/or liability for them are and will remain relevant, as both adults and minors happen to commit administrative violations. According to the Law on Administrative Liability (Administratīvās atbildības likums), which has entered into force relatively recently, due to the age of children, the penalties and/or punishment imposed on them are less severe – in addition to administrative liability, there are also coercive measures of an educational nature (audzinoša rakstura piespiedu līdzekļi). However, it has now been multiple years since the Ombudsman has released an instruction (norādījumi) on the fact that officials unreasonably apply administrative penalties without taking into account the priority of applying coercive measures of an educational nature. This is also significant and can be studied in the context of changes before and after the entry into force of the Administrative Liability Law. Research goal: While analyzing the legal regulation of liability for administrative violations committed by minors, to study and describe the problems that arise when applying the law, as well as the problems that arise when the priority of the types of liability provided for in the norms of the Administrative Liability Law is not observed. Research results: In the course of the research, the scientific literature and legal acts on the legal regulation of liability for administrative violations committed by minors, its historical genesis, as well as its problems today were researched and analyzed.
