Abstract
Katra bērna labākajās interesēs ir uzaugt ģimenē, jo tikai ģimenē bērns apgūst sabiedrībā nepieciešamās lomas, uzkrāj sociālo pieredzi un iemaņas, kas ir svarīgas nākotnē, kā arī gūst priekšstatu par savstarpējām attiecībām un vērtībām. Bērna labāko interešu princips ir plašs un nav skaidri definēts. Bērns piedzims vecākiem – ģimenē, taču ne vienmēr bērns uzaug savā bioloģiskajā ģimenē un dzīvo ar vecākiem.
Pētījumā tiks analizēts bērna labāko interešu saturs Latvijas un starptautiskajos normatīvajos aktos, raksturota pašreizēja ārpusģimenes aprūpes sistēma, analizējot ārpusģimenes aprūpes tiesisko regulējumu, izdarīti secinājumi un sniegti priekšlikumi ārpusģimenes aprūpes sistēmas pilnveidei.
Lai sasniegtu darba mērķi, autore pētījumā aplūkos un analizēs Latvijas un starptautisko normatīvo aktu regulējumu aizgādības tiesību un ārpusģimenes aprūpes jautājumos, kā arī izpētīs bāriņtiesas un ārpusģimenes aprūpes pakalpojumu nodrošinātāju tiesiskās attiecības.
It is in the best interests of every child to grow up in a family, because only in the family the child learn the roles needed in society, accumulate social experience and skills that are important in the future, as well as gain an idea of mutual relationships and values. The principle of the best interests of the child is broad and still not clearly defined. The child born to the parents – in the family, but the child does not always grow up in his biological family and live with the parents. The study will analyse the content of the best interests of the child in Latvian and international normative acts, describe the current out-of-home care system, analyse the legal regulation of out-of-family care, draw conclusions and provide proposals for the improvement of the out-of-family care system. In order to achieve the aim of the work, the author will examine and analyse the regulation of Latvian and international regulatory enactments in matters of custody and out-of-family care, as well as study the legal relations between orphan courts and out-of-family care providers.
