Abstract
Autore darbā pēta informētas piekrišanas aspektu, kuru regulē starptautiskie tiesību akti un Latvijas Republikas tiesību akti. Autore par tēmas aktualitāti uzskata ārsta informācijas sniegšana pacientam, jo saprotami sniegta formā informācija dod pamatu brīvai un apzinātai piekrišanai/atteikšanas ārstniecības procesam, kā arī nodrošina uzticību un labu komunikāciju starp pacientu un ārstniecības personu.
Darba problemātika- informētas piekrišanas nodrošinājums un nenoteikti atbildības veidi par likuma neievērošanu. Darba mērķis ir izpētīt informētas piekrišanas saistītus tiesību aktus, konstatēt nepilnības, piedāvāt iespējamos risinājumus. Darbs iedalīts četrās nodaļās, kurās autore aplūko, informētas piekrišanas saturu, tiesisko regulējumu, atteikšanos no ārstniecības un problemātiku. Galvenais secinājums ir tāds, ka praksē ārsti nepilnvērtīgi nodrošina informācijas sniegšanu pacientam informētas piekrišanas aspektā, kā rezultātā tiek aizskartas pacienta tiesības. Autore uskata par nepieciešamu paredzēt kriminālatbildību par šādu pārkāpumu.
The author studies the aspect of informed consent, which is regulated by international legal acts and legal acts of the Republic of Latvia. The author considers the provision of doctor's information to the patient to be topical, as the information in a comprehensible form provides a basis for free and informed consent / refusal of the treatment process, as well as ensures trust and good communication between the patient and the person treated. Problems of work - provision of informed consent and unspecified types of liability for non-compliance with the law. The aim of the work is to study the legislation related to informed consent, to identify shortcomings, to offer possible solutions. The work is divided into four sections, in which the author looks at the content of informed consent, legal regulation, refusal of treatment and issues. The main conclusion is that, in practice, doctors are not able to provide information to the patient in the aspect of informed consent, as a result of which the patient's rights are violated. The author considers it necessary to provide for criminal liability for such a violation.
