Abstract
Bērna tiesības ir nostiprinātas gan Starptautiskajos tiesību aktos, gan nacionālajā normatīvajā regulējumā, nosakot bērna intereses prioritāras. Lai bērnam tiktu nodrošināta iespēja pilnvērtīgi attīstīties un uzaugt ģimeniskā vidē, neatņemamās bērna tiesībām ir tiesības uzaugt ģimenē. Tomēr tiesību normas sniedz valsts un pašvaldību institūcijām šo neatņemamo bērnu tiesību ierobežošanā, ja vecāki vai viens no vecākiem, aizbildnis vai audžuģimene apdraud bērna dzīvību vai veselību. Bakalaura darba ietvaros tika pētīts bērna tiesības uz ģimeni un valsts pienākums šo tiesību īstenošanā, konstatēt tiesiskā regulējuma problemātiku un izstrādāt priekšlikumus tiesiskā regulējuma pilnveidošanai. Valsts pienākums ir ne tikai nodrošināt bērna tiesību aizsardzību, bet arī pienākums sniegt ģimenēm sociālo palīdzību, lai tiktu nodrošinātas bērna tiesības uzaugt ģimenē. Bakalaura darbā ir pētīs ģimenes institūta saturs un jēdziens, kā arī analizētas bērna tiesības starptautiskā un nacionālā kontekstā. Ņemot vēra, ka valsts pienākums ir īstenot bērna tiesības uzaugt ģimenē, darba autore aplūkoja kā valsts īsteno šīs tiesības, pirms bērns tiek nošķirs no ģimenes un kā tiek ievērots samērīguma princips par bērna nošķiršanu un ārpusģimenes aprūpi. Neskatoties uz to, ka valstij ir tiesības bērnu nošķirt no ģimenes, tomēr valstij ir jāveicina ģimenes atkalapvienošanās, lai nodrošinātu bērna vislabākās intereses – uzaugt ģimenē.
The rights of the child are enshrined in both international law and national regulation frameworks, prioritising the best interests of the child. In order to provide the child with the opportunity to develop and grow up fully in a family environment, the inalienable rights of the child have the right to grow up in a family. However, legal norms shall be provided to State and local government institutions in restricting the rights of these inalienable children if the parents or one of the parents, guardian or foster family endanger the life or health of the child. As part of the bachelor's theses , the rights of the child to the family and the State's duty to implement these rights, to identify the problems of the legal framework and to develop proposals for improvement of the legal framework were investigated. It is the duty of the State not only to ensure the protection of the rights of the child but also to provide social assistance to families in order to ensure the right of the child to grow up in the family. The Bachelor's work will explore the content and concept of the family Institute and analyse the rights of the child in an international and national context. Given that the State is obliged to exercise the right of the child to grow up in the family, the author of the work considered how the State exercised that right before the child was separated from the family and how the principle of proportionality concerning the separation of the child and out-of-family care was respected. Although the State has the right to separate the child from the family, the State should promote family reunification in order to ensure the best interests of the child – to grow up in the family.
