Abstract
Saskarsmes loma un nozīme cilvēka dzīvē ir nenovērtējama. Saskarsmē cilvēks mācās un izpaužās kā personība, tāpēc jebkuram bērnam, neatkarīgi no viņa vecuma, kurš ikdienā nerealizē saskarsmi ar to vecāku ar kuru nedzīvo kopā, savā attīstības periodā zaudē iespēju augt un pilnveidoties pilvērtīgi. Pienācīgi atrisinot jautājumu par saskarsmi, tiek sniegta iespēja bērnam saņemt aprūpi un komunikāciju, kā rezultātā bērns ir tikai ieguvējs.
Bakalaura darba mērķis ir izpētot saskarsmes tiesību tiesisko regulējumu un tā piemērošanu, identificēt problemātiku un izstrādāt ieteikumus tiesiskā regulējuma pilnveidei.
Bakalaura darbu veido ievads, trīs pamatnodaļas, kuras ir sadalītas vairākās apakšnodaļās, secinājumi un priekšlikumi un izmantotās literatūras saraksts. Darba struktūra izvēlēta, lai loģiski un secīgi atklātu saskarsmes tiesību institūta īstenošanas problemātiku.
Darba ievadā ir pamatota pētāmās tēmas aktualitāte ar statistikas datiem, norādīts pētījuma mērķis un mērķa sasniegšanai izvirzītie uzdevumi, norādīts pētījuma priekšmets un objekts, kā arī raksturotas pētījumā izmantotās zinātniskās metodes un tiesību normu interpretācijas metodes.
Darba pirmajā nodaļā autore aplūko saskarsmes tiesību būtību, definē saskarsmes tiesību jēdzienu, kā arī nacionālos un starptautiskos normatīvos aktus, kuri prasa ievērot bērna labāko interešu nodrošināšanu.
Darba otrā nodaļa veltīta jautājumiem, kas skar saskarsmes tiesību nodrošināšanu. Aplūkoti jautājumi par iespējām noregulēt saskarsmi noslēdzot vienošanos vai ar tiesas sprieduma palīdzību, izskaidrota to procesuālā darbībā kā arī sekas.
Bakalaura darba trešajā nodaļā autore izskata vecāku un bērnu tiesības un pienākumus saskarsmes tiesību īstenošanā kā arī iespējas nodrošināt bērna/-u un vecāku saskarsmi saskarsmes personas klātbūtnē.
Pamatojoties uz zinātnisko avotu teorētisko analīzi un pētījumā iegūtajiem empīriskajiem rezultātiem, ir izdarīti secinājumi un izteikti priekšlikumi.
Bakalaura darbā izmantotās literatūras saraksts sastāv no 58 avotiem latviešu, angļu un krievu valodās, tiesību aktiem, tiesu prakses materiāliem un oficiālām publikācijām.
The role and importance of communication in human life is invaluable. In communication, a person learns and expresses himself as a personality, therefore any child, regardless of his age, who does not have contact with the parent with whom he does not live on a daily basis, loses the opportunity to grow and improve fully during his development. Properly resolving the issue of communication provides the child with the opportunity to receive care and communication, with the result that the child is only the beneficiary. The aim of the bachelor's thesis is to study the legal regulation of access rights and its application, to identify the problems and to develop recommendations for the improvement of the legal regulation. The bachelor's work consists of an introduction, three basic sections divided into several sub-chapters, conclusions and proposals and a list of authorities used. The work structure has been chosen to identify, in a logical and sequential way, the problem of implementing the Institute for Rights of Access. The work introduction is based on statistical data on the topics to be studied, indicates the purpose of the study and the objectives for achieving the target, indicates the subject matter and object of the study, and describes the scientific methods used in the study and the methods for interpreting legal norms. In the first section of work, the author looks at the nature of the right of access, defines the concept of rights of access, as well as the national and international laws, which require compliance with the best interests of the child. The second chapter focuses on issues relating to the enforcement of rights of access. The issues concerning the possibility of adjusting access through an agreement or through a court judgment are addressed, explained in their procedural action as well as the consequences. In the third chapter of the work of the Bachelor, the author shall examine the rights and obligations of parents and children in the exercise of rights of access, as well as the possibilities of ensuring the contact of the child (s) and parents in the presence of the person in contact. On the basis of a theoretical analysis of scientific sources and the empirical results of the study, conclusions have been drawn and proposals have been made. The list of literature used in the work of the bachelor consists of 58 sources in Latvian, English and Russian languages, legislation, case-law materials and official publications.
