Abstract
Bakalaura darba tēma ir “Elektroniskais dokuments kā pierādījums civilprocesā”. Pierādījumu institūts ir civilprocesa pamatelements, tādēļ arī nozīmīgs civiltiesisko attiecību veiksmīgai realizācijai un taisnīgai tiesai. Mūsdienās, attīstoties tehnoloģijām, attīstās arī informācijas aprite, uzglabāšana un izmantošana vairākos veidos. Ņemot vērā to, ka rakstisku dokumentu papīra formātā sāk aizstāt elektroniskais dokuments, tiesai arvien biežāk nāksies saskarties ar elektronisku dokumentu kā pierādījumu novērtēšanu. Civilprocesa likumā elektroniskie dokumenti kā pierādījumi tiek iekļauti pie rakstveida pierādījumiem, neskatoties uz to savstarpējām atšķirībām un elektroniska dokumenta īpatnībām. Šāds regulējums nenodrošina pilnīgu elektronisko dokumentu pārbaudi, novērtēšanu un izmantošanu. Darba mērķis ir izpētīt rakstveida pierādījuma un elektroniska dokumenta jēdzienus, īpatnības, to izmantošanu, vērtēšanu tiesā un izzināt pierādījumu tiesiskā regulējuma problēmas. Darba gaitā tiek noskaidroti rakstveida pierādījumu veidi, analizēta elektroniska dokumenta pieļaujamība, attiecināmība un vērtēšana, kā arī to nodrošināšana, izmantošana, apstrīdēšana tiesā. Darba autore secinājusi, ka pastāv vairākas problēmas elektroniska dokumenta izmantošanai un novērtēšanai. Elektronisks dokuments kā pierādījums nevar tikt pielīdzināts rakstveida pierādījumam, jo tie atšķiras pēc to formas, satura, iegūšanas veida, glabāšanas veida un vietas, kā arī novērtēšanas. Elektronisko pierādījumu iesniegšanai ir liela nozīme to izmantošanai, novērtēšanai, ticamības un drošuma nodrošināšanai. Analizējot tiesu praksi un tiesību zinātnieku darbus, noskaidrots, ka elektroniskos dokumentus kā pierādījumus nevar vērtēt ar tām pašām metodēm, ar kurām vērtē rakstveida pierādījumus. Darbā identificētajām problēmām autore piedāvā risinājumus elektronisko pierādījumu tiesiskā regulējuma pilnveidei. Darbs sastāv no 53. lpp. un izmantoto avotu saraksta.

The title of the Bachelor's Thesis is "Electronic document as evidence in Civil Proceedings". The institute of evidence is a basic element of Civil Proceedings, therefore it is also important for the successful realization of Civil Law relations and a fair trial. Nowadays, with the development of technology, the flow, storage and use of information in several ways is also evolving. As the written document in paper form is being replaced by the electronic document, the court will increasingly have to deal with the evaluation of the electronic document as evidence. In the Civil Procedure Law electronic dociment as evidence is included in written evidence, despite the differences between them and the peculiarities of an electronic document. Such regulation does not ensure the full examination, evaluation and use of electronic document. The aim of the work is to study the concepts, peculiarities of written evidence and electronic document, their use, evaluation in court and to find out the problems of legal regulation of evidence. Author concluded that electronic document cannot be equated with written evidence as evidence as it differs in form, content, type of acquisition, type and location of storage, and evaluation. The submission of electronic evidence is important for its use, evaluation, reliability and security. An analysis of Case Law and the work of legal scholars has shown that electronic evidence cannot be assessed using the same methods as written evidence. The author offers solutions to the problems identified in the work for the improvement of the legal regulation of electronic evidence. The work consists of 53 pages and list of used sources.
