Abstract
Maģistra darba tēma ir “Darba koplīguma tiesiskā regulējuma problemātika”. Darba tiesiskajās attiecībās viens no Latvijas Republikas Satversmē noteikto pamattiesību – apvienošanās brīvība, savu tiesību aizstāvību, īstenojamas ar darba koplīguma noslēgšanu. Koplīgumu slēgšana nepieciešama, jo ne visus noteikumus, kas paredz darbiniekam labvēlīgākus nosacījumus, ir ērti noteikt katra darbinieka darba līgumā.
Kā tiek norādīts literatūrā salīdzinot ar citām valstīm Latvijā šis institūts nav pietiekoši nostiprināts un pilnvērtīgi netiek izmantotas koplīguma gan starptautiskajos, gan nacionālajos normatīvajos aktos minētās priekšrocības darbiniekiem ne tikai ekonomisko, bet arī darba vides aspektu uzlabošanā. Valsts pienākumu nodrošināt koplīgumu nosacījumu nosaka gan starptautiskie līgumi un konvencijas, gan Eiropas Savienības Direktīvas. Tajā pašā laikā DL un citos tiesību aktos iekļautas normas, kuras ierobežo darbinieku tiesības uz apvienošanos un koplīgumu noslēgšanu, kas var radīt Satversmē noteikto pamattiesību ierobežošanu.
Autore maģistra darbā izvirzījusi sekojošu mērķi analizējot darba koplīguma tiesisko regulējumu darba tiesiskajās attiecībās, analizējot Darba likumu un citus normatīvos aktus darba koplīguma ietvaros, noskaidrot priekšnoteikumus darba koplīguma noslēgšanai, identificēt problēmjautājumus saistībā ar darba koplīguma regulējošo tiesību normu piemērošanu praksē, kā arī sniegt atbildes uz tiem.
Maģistra darba ietvaros veikti secinājumi par Latvijas normatīvo aktu atbilstību starptautiskajām tiesību normām, konstatēti trūkumi darba koplīguma tiesiskajā regulējumā un izteikti iespējamie risinājumi trūkumu novēršanai, veicot grozījumus Darba likumā.
The theme of the Master's thesis is "The problem of the legal regulation of the collective agreement". In labor legal relations, one of the fundamental rights specified in the Satversme of the Republic of Latvia - freedom of association, protection of one's rights, shall be implemented by concluding a collective labor agreement. Collective bargaining is necessary because not all provisions that provide for more favorable conditions for an employee are also set out in each employee's employment contract. As indicated, the comparison of the literature with all countries in this institute is not a sufficient reinforcement and complete non-use of the benefits for employees mentioned in both international and national regulatory enactments in improving not only economic but also working environment aspects. The conditions of collective agreements for the fulfillment of state obligations are determined by both international agreements and European Union directives. At the same time, the norms included in the DL and other legal acts, which restrict the right of employees to unite and conclude joint agreements, which may create a restriction of the fundamental rights established in the Satversme. The author of the master's thesis sets out the following goals of researching the significance of a collective labor agreement in labor relations, analyzing the Labor Law and other regulatory enactments within a collective agreement, clarifying the preconditions for concluding a collective agreement, identifying solutions to problems with collective bargaining practices and responding to them. In the field of the Master's thesis, there are conclusions on the compliance of Latvian regulatory enactments with international legal norms, which have been identified as deficiencies in the legal regulation of the collective labor agreement and expressed as possible solutions to the shortcomings by amending the Labor Law.
