Pētījuma mērķis: Izpētīt un izanalizēt notikuma vietā mirušās personas līķa apskates tiesisko regulējumu un sniegt iespējamos priekšlikumus tā pilnveidei.
Pētījuma jautājums: Kā patrreizējais tiesiskais regulējums ietekmē mirušas personas līķa apskati notikuma vietā un izmeklēšanu kopumā, un kādi grozījumi veicami normatīvajos aktos mirušas personas līķa apskates procesa uzlabošanai?
Pētījuma uzdevumi:
1. Izpētīt un izanalizēt notikuma vietas un līķa apskates jēdzienu un mērķi;
2. Izpētīt un izanalizēt līķa apskati notikuma vietā reglamentējošos normatīvos aktus;
3. Izpētīt un izanalizēt līķa apskates notikuma vietā tiesiskā regulējuma nepilnības un piedāvāt iespējamos risinājumus.
Pētījuma metodes: Dedukcija, indukcija , analīze, sintēze, deskriptīvā metode, statistikas metode.
Pētījumā iegūtie rezultāti: pētījumā tiek secināts, ka praksē būtiska problēma ir tas, ka netiek nodrošināta tiesu medicīnas ekspertu piedalīšanās līķa apskatē, kas ir pretrunā Kriminālprocesa likuma nosacījumiem un kriminālistikas un tiesu medicīnas rekomendācijām. Darbā tiek izvirzīti priekšlikumi normatīvā regulējuma uzlabošanai, lai šo problēmu novērstu.
Title of the bachelor's thesis: Problems of the legal regulation of the examination of a deceased person. Aim of the research: To study and analyze the legal regulation of the examination of the corpse of a deceased person at the scene and to provide possible proposals for its improvement. Research question: How does the current legal regulation affect the examination of the body of a deceased person at the scene and the investigation in general, and what amendments should be made to the regulatory enactments to improve the examination of the body of a deceased person? Research tasks: 1. To study and analyze the concept and purpose of the scene and the examination of the corpse; 2. To study and analyze the regulatory enactments regulating the examination of a corpse at the scene; 3. To study and analyze the shortcomings of the legal regulation at the scene of the examination of the corpse and to offer possible solutions. Research methods: Deduction, induction, analysis, synthesis, descriptive method, statistical method. Results of the study: The study concludes that a significant problem in practice is that the participation of forensic experts in the examination of the corpse is not ensured, which is contrary to the provisions of the Criminal Procedure Law and the recommendations of forensic and forensic medicine. The paper puts forward proposals for improving the regulatory framework to address this problem.
